Onshore Servers Terms of Service & Acceptable Use Policy
If you choose our Onshore Servers hosting option, this page sets out the specific Terms of Service (ToS) and Acceptable Use Policy (AUP) that apply. Because Onshore Servers operate under extra regulatory and legal obligations, their rules may differ from our offshore hosting. Make sure you read carefully, by using Onshore Services, you agree to these terms.
1. SCOPE & RESPONSIBILITY:
- Onshore Services require compliance with the laws and regulations of the hosting jurisdiction.
- As a customer, you are fully responsible for any content, data, or activity hosted under your account.
- We act as a technical infrastructure provider only – we do not pre‑screen or monitor content. But we do respond promptly to any valid abuse notice or legal request.
- All content and data you host must comply with applicable law, including copyright, intellectual property, and privacy laws.
- In case of valid copyright or legal complaints (e.g. DMCA takedown requests), you must respond or remove infringing material immediately.
- Failure to comply may result in suspension or termination of services.
3. PROHIBITED CONTENT & ACTIVITIES:
The following are strictly forbidden under Onshore hosting (non‑exhaustive list):
- Illegal content (child abuse, exploitation, hate speech, illicit drugs, etc.)
- Pirated or copyrighted material without proper rights.
- Phishing, scams, fake‑replica product sites, fraudulent or deceptive websites.
- Distribution of malware, viruses, botnets, hacking tools or scripts.
- SPAM / unsolicited mass‑emails (UCE), bulk mailing abuse.
- Hosting of illegal financial / investment schemes, unlicensed forex/ICO/cryptocurrency schemes.
- Denial‑of‑Service attacks, network abuse, IP‑spoofing, open proxies, TOR exit nodes.
- Any content or activity violating local laws or infringing third‑party rights.
We reserve the right to refuse, suspend, or terminate any account engaging in prohibited activities, without prior notice.
4. ABUSE & COOPERATION WITH AUTHORITIES:
- Onshore Servers users must cooperate with valid legal requests from law enforcement or courts.
- Upon receiving a valid legal order or abuse report, we may disclose relevant data (e.g. logs, user info) as required by law.
- We do not guarantee data shielding or anonymity beyond what the law allows.
5. SECURITY & ACCOUNT INTEGRITY:
- You are responsible for maintaining secure credentials and access.
- Sharing account login details, or allowing unauthorized access, is strictly prohibited.
- You may not use your account to attempt unauthorized access to other systems, perform scans, or exploit vulnerabilities.
- Onshore hosting includes standard resource limits; you must not overload servers or degrade performance.
- For VPS / Dedicated plans: if you don’t purchase additional backup service, backups are your responsibility.
- WebCare360 assumes no liability for data loss – always keep your own backups.
7. UPTIME & LIABILITY:
- We aim for high network uptime, but Onshore hosting does not guarantee service uptime under all conditions.
- Downtime caused by external factors (force majeure, legal shutdowns, maintenance, abusive users, etc.) is excluded from compensation.
- WebCare360 is not liable for losses from downtime or data loss beyond network infrastructure failures.
- Onshore plans are subject to the same cancellation/refund rules as stated in our main policy.
- Refunds are only issued if downtime or failure is directly attributable to WebCare360.
- Refunds will be denied if termination was due to user violation or illegal content.
9. INDEMNIFICATION:
You agree to indemnify and hold WebCare360 and its affiliates harmless against any third‑party claim or liability arising from your content or use of Onshore Services, including legal costs, damages, fines, or penalties.
10. MODIFICATIONS TO POLICY:
We reserve the right to update or modify this Onshore ToS/AUP at any time. Updated terms will be posted on this page, and your continued use of services constitutes acceptance of those changes.
